In NIFLA v. Becerra, Court Weighs Challenges to the FACT Act, a California Law That Provides Women with Timely and Accurate Information About Their Full Range of Reproductive Health Options

Washington, D.C. (March 20, 2018) – Today, the United States Supreme Court heard oral arguments in NIFLA v. Becerra, concerning challenges to the Reproductive FACT Act, a straightforward California law that provides women and their families with access to timely, full, and accurate information about the full range of their reproductive health care options.

“These fake women’s health centers exist for one reason alone: They cannot compete without deception. They have to trick people into entering their fake centers just to push their ideology and shame women. That’s never been more clear than today,” said Ilyse Hogue, President of NARAL Pro-Choice America. “Today, we rallied to make clear that every woman should be able to seek reproductive care provided by actual doctors, using timely, complete, and accurate information. We stood up and spoke out to say that every woman, every family, and every American, deserves to lead the life of their own choosing — not dictated by other people’s judgments, other people’s values, or other people’s agendas. No matter what, we will keep standing up to falsehoods, swatting away the lies, and speaking the truth.”

“Women weighing important and timely medical decisions that will impact the rest of their lives deserve to have all the facts when they need them, in order to make the best decisions about their own health, lives, and futures,” said Amy Everitt, state director of NARAL Pro-Choice California. “I am hopeful that the Supreme Court will rule with women and their families in California and across the country who want to end the lies and provide women with comprehensive, accurate information on their pregnancy-related decisions.”

Outside the Court today, activists and leaders from across the country representing reproductive rights, civil rights, and social justice organizations held a rally calling on fake women’s health center to stop their deceptive practices that prevent women from receiving timely, vital, and accurate information about their health care. The rally follows a nationwide week of action last week as part of the #EndTheLies campaign, highlighting the importance of the FACT Act, the dangerous and deceptive practices of fake women’s health centers, and the significance of this case.

Fake women’s health centers are facilities that purport to offer pregnancy-related health care and medical services. Instead, they prey on women at a vulnerable moment in their lives by pushing medically inaccurate information, using deceptive advertising, misleading websites, and engaging in a variety of other dishonest tactics to lure women seeking care and information about their full range of health care options into visiting these facilities. The FACT Act helps provide important, accurate, and honest information to pregnant women; makes sure anyone who claims they provide medical advice and/or medical care is held to a high standard of honesty and professionalism; and makes sure women receive accurate information about their full range of options and programs related to pregnancy and family planning in a timely manner.
